Terms of Service

These Terms of Service ("Terms") govern your use of the BackgroundCheck mobile application (the "Service"), operated by Freeborn Corp ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

IMPORTANT - NOT A CONSUMER REPORTING AGENCY. We are not a "consumer reporting agency" as defined by the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq., and the reports provided through the Service are not "consumer reports" as defined by the FCRA. The Service may NOT be used, in whole or in part, to determine any person's eligibility for: employment or volunteer positions; housing or tenancy; credit or loans; insurance; education, scholarships, or professional licensing; or any other purpose covered by the FCRA.

1. Permitted Use

The Service provides access to public record information for general informational and personal reference purposes only. You may use the Service only for lawful purposes that are not covered by the FCRA.

Before each search, you will be required to certify that your use is not for an FCRA-regulated purpose. Misuse of the Service may subject you to civil and criminal liability, and we may suspend or terminate your access without notice.

3. Accuracy of Information

Reports are compiled from public records and third-party data sources. We do not guarantee that the information is accurate, complete, or current. Records may be incomplete, contain errors, or relate to a different person with similar identifying information. You are solely responsible for independently verifying any information before relying on it.

4. Payment

Each background check requires payment of the fee displayed in the app at the time of purchase, processed through Apple In-App Purchase. All sales are final. Fees are non-refundable once a search has been submitted, including searches that return no records.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE REPORT GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
